Im of the opinion that Goslings were fine to defend their trademark.
Think of the Bacardi cocktail - they wanted customers to get Bacardi in a Bacardi Cocktail & stop bartenders substituting 'inferior liquor'.
Goslings 'made' the Dark & Stormy, they don't want you to substitute the liquor with another one (even if you prefer it).
Its a bit of a storm in a teacup really - if you ask for a Dark & Stormy in a bar, they'll cobble something together for you with or without Goslings.
At home you can do what you like - have a 'Dark & Sue Me' & smile
